Got a packet in the mail the other day from ASCAP about paying them to have videos on our website. Have any of you ever received this crap? They want like $1200/year or close to that.
 
Unreal..................you are not even making a profit from having those on the site but I am sure they will respond that it promotes shows that will generate revenue.

It also promotes the band we pay tribute to...much moreso than us. Know how many Bon Jovi cds we've sold because people saw us and were never a fan of the band before? It's ridiculous.
 
So...what happens if you don't pay it?

What can they really do? :confused:

Or, tell them to collect the money from the venue's where it was filmed at...

Probably sue us...but I've talked to a few attorneys this morning and they all say the same thing...pay it. It looks like it might not be $1200/year...might be $340 which is the minimum. We can deal with that.
 
I'm very surprised this is the first I've heard of this happening. I figured ascap would've started cracking down on this kind of thing years ago.

BTW - I'm not saying it's right to charge you $1200. I'm just saying I'm surprised this is the first example I've heard about.

Is your band a corporate entity? If so, well, I'd not even bother.
 
No, we are not even registered as a business right now because of the name change we recently went through.
 
Just another example of the music industry beating up the little guy.

Let us know how it turns out...
 
Good thing you arent here in Nashville. They have been known to drop into the venues on the strip and demand compensation either from the bar/venue owners or cover bands. The more popular you are the bigger target you become.

Lemme get this straight. You actually believe that your tribute band has some sort of significant effect on Bon Jovi CD sales? That's kinda funny... :lol: :LOL:

As much as I dislike handing any one money...we are talking about videos that have you guys perform material that you don't have the copyright for and host them on your site to draw folks to your shows right?

never said significant...but we do get a lot of people that tell us this crap. i think it's funny too

we don't mind paying...we just don't want to get raped by companies that are obviously out to make a quick buck also.

That's what happens when you use some one else's copyright...we spent 12oo bucks this Summer on licensing on CD sales...

This is the answer. As much as you may not like, or others may not like having to pay money for this sort of thing, Keep in mind Ascap generally is FOR musicians, and if it was the other way around, you would be a happy camper. Ascap actually does Not take that much in percentages from what Goes to the artist, so don't think of it as ascap getting rich off of the little guys, this is the law, and as a full time composer and artist, I can say I am glad that agencies enforce copyright and intellectual property protection, though that figure seems steep. We can also blame the people who have blatantly disregarded the process and have stolen music after music track for the tougher enforcement. Ascap isn't really the bad guy
