Deal gone bad

I have been on the forum here for a while now. I do not post much and have never been one to hash out my problems in public, but I am having an issue with a member here and figured I would post all of this crap and see if I should go public with his name.. I did not want to even spend the time messing around with this but this seller seems to have a real attitude problem and I am just sick of it. He is holding my money at this point.

I am no angel and do not like to take crap from people, but I have ALWAYS been a standup guy when it has come to transactions here on Rig talk. I have traded gutiars, amps and bought and sold a lot of gear on this forum.

So I purchased an effects unit from a RT member last week. (Tuesday) He said he would send it out the next day. Come Thursday I have no shipping info. I contact the seller and ask if ity had been shipped. he says no, he's been too busy to ship and he would ship the next day.. (Friday)

On Friday am I tell him it's not very cool that since HE told me it would ship the next day. I told him I needed the unit by the weekend and that he should have been prepared to ship the item immediatly after selling it (remember he said he would ship the next day) He proceeds to tell me that he has no problem spinning this around on me since I never told him I needed it by the weekend. Remember, he told me twice he would ship it out the next day after purchase, so I had no reason to tell him I needed
it by the weekend.

This is where things went downhill fast.

I am getting a little frustrated at this point. I do admit me saying 4 days to ship at this point is incorrect, but that is really a non-issue.

My response:

Not real cool man. You said you would ship Wednesday and then went out of contact. So 4 days after you said you would ship you MAY ship it on Saturday? Not very considerate. I needed that unit this weekend.
You should have been prepared to send it out immediatly.
I am close to asking for my money back dude..

Relax, it's not 4 days. You paid at 5:50pm on Tuesday. Sorry, but I couldn't ship Wed or Thurs, but I can ship today without issue.

And please don't tell me what I should have done, because I have no problem spinning it around on you for not even mentioning that you needed it for this weekend. Had I known I would have done a better job getting it out for Wed or Thurs.

(At this point I am done with this guy.. He has a jackass attitude. I have never had a bad deal either buying or selling here so I just want out of the deal. Yes, I was short on patience. But I am not going to have this guy try to turn this on me. I just called him out on what he said he would do) Again, I was off a day when I said 4 days.. My bad.. Sounds to me like you said you would ship it the next day, you told me that twice! Then earlier today you said you would not ship today but you would on saturday.. THAT WOULD BE 4 DAYS! WTF man? You tell me to relax? you said you would ship the next day, why would I tell you I needed the unit if you were going to ship the next day?
Try to spin it around on me all you want but you are the one who is fucking around. Not me.

What are you talking about??? I never once said anything about Saturday. Maybe you've got me confused with another guitar toy deal that you're impatiently waiting for like a six year old on Christmas morning.

I said I can ship it for sure today, which is Friday.

Just a little info since you're incapable of understanding reality; Not all of us sit on the computer all day and dream about the new toys we're going to buy, and then wait like a puppy for the UPS guy to arrive. Thankfully, some of us have lives, own and operate businesses, have health issues, and so on. Therefore, ALL internet deals for toys are SECONDARY. LIFE COMES FIRST.

I've already said I'm sorry for being a whopping 48hrs behind. Not much more I can do. You're just as much at fault for not even mentioning that you absolutely needed to have it for your big show. Gear is important to my shows as well, so had I known it was mission critical, I would have made absolute time to ship it out. Next time say something - Simple as that.

Anyway, I'll gladly refund your money because judging by your rude & inconsiderate attitude, your unnecessary swearing, and your childish impatience, you're obviously a teenager, or an unstable adult, neither of which I care to do deal with.

If you desire to make a claim with Paypal, go right ahead, because you're obviously unaware of how long the process takes. Your money will be tied up for at least 7 to 10 days while they do an investigation.

Paypal does not work on my phone and I'm loading a crew into a show right now, so if you're willing to wait a couple hours longer I'll be at computer at about 3 or 4pm central. At that point I will refund your money if that's the route you choose to go.

I leave town for the weekend, I cannot acces emails or internet so I cannot check my pm's or payapl account to see if he issued a refund. Imagine that, he did not pay, nor did he respond.

I sent another pm to him today.. With no response.

It seems by his last response he was basically daring me to file a dispute with Paypal. Which I have done now.

It is now Wednesday, 8 days after this clown took my money and I still don't have my refund. This guy is getting my PM's and not responding. What a tool..
 
Sucks. Hope it works out for you both. To an outside observer, looks like the seller didn't really do what they said, whether it was 4 days, 5 days, 3 days, whatever, doesn't really matter. Also didn't keep you updated. You probably could have phrased this reply a little more diplomatically IMO...

but it doesn't really matter. The seller didn't do what they said, and didn't keep you posted. Once you decided to ask for a refund I would have just said, I'd like a refund at this point and left it at that. No point arguing with someone over how many days it's been, cussing back and forth etc. Again, hope you get your money back. We have a good forum and a lot of good members, but just a chance we take with online deals.
 
Seller said it would ship the next day...it didn't. I can't see how you're at fault in any way, shape, or form.

Do the rest of us a favor and out the seller. His replies as posted above are enough to qualify him as a first class douchebag and someone with whom I would not want to do business.
 
Looks too me like you're being impatient. Your first reply after he told you he was sorry he couldnt ship was uncalled for. Life happens and a day or two isnt the end of the world. Your dealing with a person not a business...

If it was me, I would have refunded your money and told you to go scratch...
 
Communication is always key, and he obviously didn't communicate too well, but then again, neither did you...if I HAD to have something by a certain day, I would have made sure the seller was aware of that need.

Not knowing your situation may have caused him to prioritize something else that came up in his life...still should have communicated, but I can see how it may have happened...

He definitely could (should) have been cooler in his responses.

You probably could have worded yours a bit differently, as well.

The fact that he didn't just issue the refund is pretty unfortunate.
 
Life happens my ass. You take the money, you ship as soon as possible. If life gets in the way, you refund the money. Selling stuff on the net since '95. The rule is you don't f*ck around with someone else's money.
 
It seems like a lot of deals go bad due to poor communication

Exactly!!! How the f*ck can any of you place one ounce of blame on the buyer??? If the seller says he's shipping the next day, the buyer has no reason to express the urgency on his end. If he did do that, people would probably jump on him for being overbearing.

Place the blame where it belongs...100% with the seller. Poor communication and a failure to deliver as promised...anything said/done by the buyer after that is completely irrelevant.
 
Agree with the buyer here. Ship when you say you will. Pay when you say you will. We are only as good as our word, especially in the internet age.

I had no reason to tell him I needed the unit, he told me twice he would ship the unit the next day... Of course I need the unit, I bought it..

The seller is KLARK..

I understand your frustration, but I think you're overreacting a little. At no point did it seem that the transaction was in danger of NOT happening. So, you had to wait a few extra days. Life is too short to sweat stuff like this.

Granted, it would be different if you had expressed an absolute need to have it asap (like you needed it for a session or whatever).

Just my opinion.

As a seller, if he can't ship when promised it is his duty to contact the buyer with the reason ASAP, strike one.
Now seller has promised refund but not made good. Strike two!

Why in one breath can the seller tell me he could not ship due to being busy and then tell me if I had stressed to him I needed it he suddenly would have made time to ship it? That seems wrong to me. Maybe I am impatient, but the seller should have done what he said he would do.. Then to not let me know? Why should I trust this guy? I don't know him..

Why is he still holding my money 8 days later? Because HE is acting like a jerkoff.. Not me. It's MY money, at this point I feel like the guy is NOT trustworthy at all. He's basically a thief for trying to hold may cash as long as he can. People suck.

And nevermind the way the guy spoke to me in his response, that alone made me want to end the deal with him. I want nothing to do with this guy. He seems to be enjoying himself by holding my money. He probably spent the cash already..

As above, I side with you on who's right. Yet at the same time I've always had a distaste for paypal. As a past dealer I never could justify giving paypal a % of my tiny wee profit. Add to that, they had the power to screw me over for deals gone bad even if I was not at fault.
I'm in no way saying that you are not right to be frustrated in this deal, but did you contact anyone(from RT) that had experience dealing with this guy before you sent your cash? And what was his record at paypal. I mean was it like 100%?
Well hopefully you get a refund one way or another. I'd never deal with someone if I didn't know his real name and real addy, yet even then I'd be sure he was in a town or city close to my contacts, friends, or family.

I've had nothing but good experiences buying & selling on this forum, but every transaction begins with a clear understanding of what the expectations are.
I've been on both sides of this- as a buyer anticipating delivery of something I couldn't wait to get my hands on and as a seller, lagging a day or two behind when I said I would ship. Communication is the key on any online transaction. Seems like it started on shaky ground from the start here. On both sides.
I also don't see how airing this publicly is doing much to help the situation.

LOL, if he's already complained to paypal then I'd guess he has nothing to loose by it. By outing the guys moniker it will either give others a warning here, or force the seller to come forward with his side of the story.
Add to that, sometimes it helps just to write down your frustrations, some may use a diary, some others use the interwez.
