Employment and Health Insurance Question

A friend of mine was recently hired to work for a company as a CNA. Even though she works 40+ hours a week, the company claims they don't have to provide her with health insurance because "technically" she works for the people she takes care of, not the company. I call bullshit. What do you guys think?

Is she on their payroll or is she getting 1099ed ?
Are they withholding taxes out of her check ?
