What say you, 2A supporters and detractors? I think it's bullshit and if you support the 2A you should be against the charges.

lawyers for the defendant argued in late 2023 that the statute Mr. Biden was charged with violating is not constitutional under court precedent, including the Supreme Court decision in New York State Rifle & Pistol Association v. Bruen.

“In truth, the statute is indefensible under the Bruen framework,” they wrote in a motion to dismiss.

Lawyers referenced a recent appeals court ruling in favor of Patrick Daniels Jr. from Mississippi. Mr. Daniels was convicted of violating the same law because he was a marijuana user who owned a gun.

Too bad for Hunter. He lied on the 4473. If it was me or you we'd be made out to be dangerous criminals and would have the full force of the law brought down on us. Tell me how I'm wrong, I'm all ears.

I agree about that, I'm saying I don't think it's a good law in the first place.

I would agree with that assessment. I don't think there should be any paperwork involved with a weapon. You should be able to mail order it or buy it at the hardware store like a hammer.

There are laws stiffening penalties for using a firearm in the commission of a crime but I don't really believe in those. You can't police thoughts, so in a free society sometimes people are going to do bad things because of the access freedom grants. Freedom and safety aren't really compatible so greater risks will be incurred.
 
this is the reason why I went so long without getting a weed card. This is how they busted fpsrussia's ass and sent him to federal prison. The caveat you can argue is at the time I filled out my form I was not using or addicted. Prove me wrong. Burden lies on the prosecution. I backslid the next day....fuck you....make sense?

they do enhancements. if you are armed during the commision of a crime it's an automatic enhancement. same as drug weights and types....among many other things. It's a game they play and they are superb at it. You can get caught with no meth but if you have the materials to make it they can try and convict you on expected yield from those items.

I was under the impression that using a firearm in the commission of a felony was a mandatory 10 years? I know in TX if you have drugs and dump it into a soda or other beverage to conceal it and are discovered they weigh the item you hid it in and hit you for that weight. A small amount of meth in a can of coke=big offense.

Regardless, the system and it's myriad laws are all screwed up. I watch police videos and it's like the cops and the criminals are all on the same level of stupid, it's almost comical except we pay for it.
 
The real problem is that armed criminal action and murder should involve massive prison sentences. No need to “Enhance”. It’s like hate crimes. If you kill someone it’s pretty clear you hate them.

The fact is almost no one actually gets prosecuted for lying on a 4473. It’s like 1%. As much as I think Hunter is a dirtbag it really wouldn’t be fair to just make an example out of him. I would think fraudulating a couple million to the IRS would buy you some time though.

As for the weed and guns thing, I’m with Von Bon Scott. Nowhere in the constitution does it give the government the authority to revoke the natural, constitutionally protected rights of a US citizen for smoking pot. Or doing any drugs for that matter.

Well, fake president Biden called more ATF funding so I think they should go ahead and make his dumbass kid be the first person to experience his daddy's policies.
 
It’s a nasty game. They only use that purchase form for entrapment. That’s it. I have seen some crazy shit in 22 years in the fed. Guys out on parole and catches one to many trout and then he’s back in prison for a violation to finish his sentence. Anywhere from 1 to 10 years. Same with a dui. Or guys get a federal firearm conviction because they were riding with someone who had a gun. Because they had a previous felony. Petty shit but it adds to their numbers. States are just as bad. One of my son’s buds got a dui. His family was out of town and he asked me to get him. I picked him up and he asked me to go to Macdonalds. I said I would but I didn’t have my wallet. He said I got paid yesterday and I have my whole paycheck. I said sorry bro but you don’t. In West Virginia they sieze what cash you have on you at the time of your incarceration. Whether it’s an hour or a week. Kid was fucked up when he checked his wallet. They took his whole check. Over $700 cash. Motherfuckers. The whole system is dirty.
