Someone stole my band's name!!!

We are both from Houston, both play "rock" and they are called "Sirens and Bombshells" also. We put a full length CD out in '05 and have been together since '02, and out of nowhere another band in Houston just happens to have the same name? No fucking way. What should I do? How should I handle this? I just need them to cease and desist. We were clearly first.

I have to say they know what they're doing, so go ahead and assume they are dicks.

Contact a lawyer, take them to court if you have to.

how do you know that they had the name first? My bands name used to be Disciple and there's probably one in every town

my band just went thru the same thing. baisically, the other engine trademarked the name in '02, so we had no real right to it.
baisically, it comes down to who really owns it, if you trademarked it, and so on. if you released a cd under that name, you may be able to fight this, but I would do a tess search first to see if anyone else has it, then spend the 275 to file and legally make it your own.
