Earcandy Cabs and legal advice

Hi there.

I'd paid in full for an Earcandy cab, first payment in May 2009, last payment in December 2009. I don't have it. Does anyone on here have good legal advice? I have Tim's number and address at my disposal. Note to self and others to not use paypal on anything that might seem fishy...

Also, read Toddf007's story on here - viewtopic.php?f=3&t=49438 did this ever get resolved?/he still post here?

Would greatly appreciate any help - I'm from the UK so I'm not so sure on where to go to solve this...
 
Someone here got screwed by them as well... cant remember who, but wait around, Im sure they will post about their experience as well. I avoid their cabs for this reason... only way I would ever buy is used, just to see what the fuss is about.

Hope you get it resolved, Didn't PayPal help you? I know you are in the UK but speaking directly with them is best. Get yourself a top up card and make the call. I have learned if a company has a bad internet rep to stay away. I always check now.

No, thanks to their 35 (or 45, can't remember) day rule, they couldn't care less after this time has past hence original post :doh: Call Tim do you mean?
 
This is going to be tough if your in UK and ear candy is here in US. Usually small claims is a waste of time but if you go about it a certain way you can get the money. A lot of hoops have to be jumped thru though.

1. find online small claims service near his shop.
2.you need someone to appear that date for you, friend, family, paid attorney. starts getting costly.
3.If you win, immediatelt ask the Judge for order to appear for examination. they have to disclose financials so you can get the dough some how.

its a bitch but doable.
 
I got a good butt-fucking from ole Tim too. I had AMEX investigate, but he went under the radar and came back to them with some excuse and that the order would be filled. That was over a year after the order. I've written it off and said to hell with it.

Even if he was in the same county, small claims commissioners (they're not judges) and the small claims system itself lacks the authority to enforce the code sections referenced on their documents and subpoenas. It's a complete waste of time unless the judgement debtor is somehow ignorant of the lack of authority and complies with payment out of fear.

The "Subpoena for Personal Appearance and Production of Documents and Things" is a joke.

Furthermore, you can't touch the debtor for 30 days after the notice of entry of judgement is mailed/delivered to the debtor so I'm pretty sure you cannot immediately file the examination subpoena immediately.

The upside is the system generates a good amount of revenue in fees thereby creating a few jobs. <burp>
 
I heard Celestion pulled their account for being overdue on their payments too
 
man that sucks, I have a buzz bomb 2x12 that I really like.
I guess I'm lucky to have bought mine on the used and not had to deal with the company who makes them.

Yeah, I've got a buddy of mine who bought one used and it sounds great. About the time I was getting ready to order was when all the stuff started about the customer service and the "they ripped me off" threads started. I sat on it and waited and I'm glad I did.
 
It says they are no longer taking orders at this time either. I think we should all send them emails with links to these threads and let them know about all the bad press they have generated by shafting people. :thumbsdown:

They have a few lame excuses/red flags right on their main page.

"Due to a storm we had during the heat wave, we could not gain access to our email server for several days and we are unable to access those emails, they were erased from the server for security purposes. If you have emailed us and have not received a response, please use our Contact us page (See Below) to resend your email and please give us one business day to respond. We apologize for any inconvenience this may have caused."

Hopefully you get your $$ back. Sadly it usually is at someones expense, but at least these people are outed.

Attorneys and authorities are a waste of time for something this small. A plane ticket and one of these should take care of it...

youre right. I started my speal off by saying its pretty much a waste of time. IF you can show good cause you CAN get the financial examination immediately. The time frame alone on the ignored emails and order etc would suffice. I was also assuming its the states. If it isnt , I am of zero help.

As far a stimulating the economy, there is always a gang banger of some kind who would be willing to kill him for you. Hey Bob whats the latest on the logos.

:lol: :LOL: Plane ticket first. On a serious note I've had dealings with international issues like this and luckily the CC company ate it. No investigation they simply write it off. I'm sure they could have found the guy but there is so much red tape and jurisdictional nonsense. :jerkit: Sorry man but it doesn't look good unless you decide to look him up. There is a long list of folks in your boat by the look of it. You guys should band together.
