I live in the epicenter of shitty laws like this, and I know exactly how they are used in actual practice, not just "how nuanced of a take can we make"

For example, my father in law's murderer is claiming multiple "mitigating factors" such as slow cognitive function, hardship from being the child of illegal immigrants, and a whole raft of other retarded bullshit that is very similar to this.

He murdered a man, and will probably end up getting 5-10 years in prison for it. That's what the defense is asking for. The prosecution believes them; he's only asking for 16. Because he's a poor son of hardworking illegals and who would pick your crops right?
Now if I murdered someone, I would go to prison for life, but we aren't talking about me. We are talking about a two-tiered justice system and the problems that creates when you codify it.

My mom was robbed at gunpoint in her driveway in FL by four "troubled youths". All of them were caught and the weapon was recovered. Slow cognitive function was used as a defense for at least one of them but they all had prior rap sheets and were either adults or close to 18. Fortunately FL is more hard nosed, and some social connections I had at the time told me they would lean on the D.A to throw the book at them but it also meant she had to attend all the court dates to help see it through. The main witness was a just-retired private investigator so the case was pretty solid. Just glad she lived through it.

And that *is* fucked up. As others already said, plenty of folks suffering from depression, PTSD, etc. and they don't go around killing people... because a decent human being still knows what's right from wrong, even if they're fighting their own demons.

Or did that rapey fuck Brock or Brent (whatshisface?...the swimmer) ever do real time, like in San Quentin?

That's the reason why this law is so problematic brother. Because it codifies a specific second tier of justice to be applied, only in cases of female offenders.

There's a million examples of this all around the world - it's just never been so brazen or so generalized as to include such a large group as "all women who have given birth."

The problem is the way this will be implemented - basically every woman who commits a serious crime, that has given birth at some point, can use this as a mitigating factor in her defense.

Yeah, unfortunately I live in literal clown world, and am already living through the consequences of a two-tiered justice system - just based on race and ethnicity, not gender.

Looks like Massachusetts is trying a different variation of two-tiered justice on for size.
 
There was a case really similar to this near me, Travis Decker, who brutally murdered his children by strangulation - he was a combat veteran, with severe, severe PTSD. I'm trying to imagine how this is different in any way except LC's suicide attempt failed?
She's a woman.

Hmm, that’s not what I meant at all. I meant this proposed amendment to the law is insane. I don’t believe trained police officiers who are forced to take out the bad guys in the line of duty,especially to save others in an hostage situation for example, are insane at all.
