MILLS ACOUSTICS: Initiating Legal action w/ other customers

i went through something similar a while ago but was lucky enough to get delivery, though it was two years after i ordered. i know how annoying these situations can be, good luck

Damn, I remember a time on the forums where you had to have a Mills Acoustics cab to be in the cool crowd.

Times change. Apparently, now you need to be involved in the Mills Acoustics class action to be in the cool crowd........

What a disaster of a situation. Sorry, Bobby - I hope you get your cash back.

What a drag to have to go through all that to get what you paid for.

I went through something similarly with Dave Mills so I will post a lot of the details here for you just in case it can help you.

BUT I want to say that even though I had gone through a LOT of BS like several others out there that I do feel these cabs have one of the best sounds to them when filled with V30's (once broken in) and the build quality is FAR above other cab companies out there (I have owned just about every 4x12 at one time that people say are the top cabs).

Here is a quick summary of my Mill's issues:

He suggested V30's to me for the cabs (he knew his cabs and I should have went with them) but I wanted what I wanted, and to be fair here, he ended up having problems getting them for me (this he said caused a delay plus he was sent the wrong speakers like three times (different ohms, not being within the same frequency range, etc.....)), however, he said he needed more time to get out the other orders ahead of mine, plus various other issues started popping up (he knew I needed the cabs by a certain time myself but was not meeting my deadlines even though I padded my schedule by at least three months).

Eventually, after more than a year of him already having my money, he sent me the cabs.

One problem for me was that I had already purchased another set of 4x12's during this time because he said they would be made and sent to me within 2 months which didn't happen so I purchased two sets of cabs that have worked well for me (I had also purchased some others during this time but eventuially sold them all to keep space for the two "stored" Mills 4x12's).

The longer version of it:

Now he was very proud as well as informative about his cabs each time I spoke with him before, during, and after the purchase.

I should say right off that he recommended over and over again V30's for the cabs but I had different speakers in mind for each cab and I eventually received the cabs with the speakers I wanted in them (Cab1: two V30's in an x-pattern with two K100's and Cab2: top row was two T100's and bottom row was two EVM BL's)

NOTE: I found later that these cabs are phenomenal sounding with the "RIGHT" speakers which ended up being all V30's as Dave Mills recommended.

Well, I finally received my two 4x12 cabs after more than a year (and many lengthy emails to him).

One thing I found right away with them was they are heavy beasts and I was getting a weird "honky" sound in one cab and a real "boomy" sound in the other (this lead me to contact Dave later for a refund which I will explain later).

NOTE: These were NOT Dave's choices for speakers in the cabs but mine (and they were the cause of the "honky" sound in the one cab and the "boomy" sound in the other).

They did have a wide dispersion to their sound they projected.

TOP QUALITY CONSTRUCTION - I have never seen a cab to this day that was made with such a detail for quality.

Seriously beautiful looking cabs!!!

I even had Dave get me the 4" casters which at the times was the only complaint I had heard about these cabs was that there were little 3" casters that made the heavy cabs hard to push especially on carpets (mine flies across carpeted floors with 4" casters)

I had him make a different jack plate so I could get mono/stereo/parallel options out of them.

Regardless of the quality, I didn't like them right off, and I tried them through several amps that I had around this time.

I contacted Dave and said I was still within my 30 day return window and I wanted my money back.

He told me he would extend the 30 day return window for me to get better acquainted with them.

Since he eventually sent them to me at the "END" of the summer I wasn't able to really try them out since my 2 months of vacation was ending (I am a teacher that has summers off which is why I wanted them from him during times where I had time to actually play them).

He told me to use them for a little while longer and if I didn't want them still then his "son" would come and get them from me in CA when he came out here for some amp show and drop some off for Mark Cameron who was suppose to start making a Mills Amp for them (I was told later Cameron never followed through with it).

I kept having to send follow-up emails asking about his "son" getting the amps with no responses and no replies to phone messages I had left him, and after three more months of this going on, he emails me back with a story of how he is having financial troubles right now and that he gave me a great deal on them and they were below what I would have paid for a certain other popular cab (he just raised his prices again and was comparing his quality to a certain German cab I owned and referred to often). He had a real "attitude" in this email.

I had to remind him about previous "email" conversations where he was suppose to refund me the money (thank God I kept every email I had sent him and received from him), and he realized he snapped at me and he was in the wrong. He said he would make it "right" with me (money back, a new custom cab, etc....) if I just kept the cabs for a little longer.

I reminded him that I had been storing these in their orginal crates and they had less than a few hours of play time on them.

He said to contact him in a few months and he would take care of me at that time.

I did email him back several times and called him with no replies back.

I kept sending those reminder emails with our conversations in them and eventually he replied back saying things became much worse for him. He said he would eventually take care of me if I sold them for less or he would lower the cost for a another cab he would make for me (I had also told him that I wanted a much smaller 4x12 cab because these were hard to lift up and down stairs even though I work out and considered a pretty strong guy).

I have kept track of conversations here about his business practices of late and I realized I probably wasn't going to get a refund and I doubt I would ever get a "new" smaller 4x12 cab.

He seemed to be a very genuine person throughout the early part of our conversations and when there was an issue with one of the cabs not working, he offered to pay to have some guy in LA take care of it.

I figured it out myself (a jack was grounding out, causing the cab not to sound), and a simple washer placed between the lock nut and plate took care of it (which he sent me).

I did finally take the cabs out of their crates after a year (since my wife was sick of seeing them sit there in the front room corner (we had a very big house during that time so it really wasn't an issue for awhile there)).

I recently started using one of them for a few hours here and there and I did find that cab started to sound a LOT better over time due to the speakers getting broken in. We replaced it with all V30's and my guitarist loved the cab. I sold it to him at a considerable loss though and I still have the other one (with all V30's now).

I started using it finally and I think it sounds great with my Mesa Mark V but I prefer my two Mesa standard 4x12 cabs with V30's and the Classic EVM's that I run in stereo with another Mark V because I can easily lift my Mesa cabs to the upstairs of my house due to their size (they are still heavy because of the EVM's but manageable).

Since the Mills are HEAVY and HUGE I can never ship them (I ditched those crates they came in) which would probably be the main way of selling this last one (hardly anyone knows of them out here in my part of CA (Anaheim area)).

You can always contact me about what I went through with Mills, even though I received my cabs, where others have not, but I went through a lot of incoveniences to just get them plus after getting them and not wanting them (especially since I had to purchase other ones during that year to use for playing) then not receiving a refund when I was still in the 30 day return window.

I will lose money on these cabs because I have listed them several times with almost no enquiries (there was one from someone wanting a major discount which is why I eventually sold the one cab to my guitarist for such a low price) so I will have lost a good amount of money plus all the time spent on emails and calls plus having to store them in their crates in my house for such a long period of time.

These cabs are HIGH QUALITY and they sound KILLER with V30's (which I found out much, much, much later) BUT if a person doesn't want a product, and there is a return policy option in place, then a person should be able to receive their money back in a timely fashion, and not be forced to store them in "hopes" of getting a refund one day (in pretty much an unused condition within their crates) ESPECIALLY "after" that person waited "over" a year to get them.

So if you need anything from me to help you get your money or cab then let me know and hopefully it can help.

MILLS ACOUSTICS: Initiating Legal action w/ other customers

Have you actually talked to an attorney about his yet? Class actions are usually directed at big pockets, and obviously Mills probably has no real assets especially if he is a LLC.

Hi, I would be interested in joining with you, but I already have filed a small claims court claim against him. I just received word back from my initial claim, and with the address I provided he was not found. What addresses do you guys out there have for him? Also, I sent a message to Toshi Iseda to inquire about Dave's business activity, and he told me Dave had not spoken to him in over a year and he was planning on moving to Ireland. So we may all be screwed. Anyways, let me know about your class action, but in my opinion it may be better to just file a small claim because if he is still in the U.S. it may not be for long and I imagine you need a good number of folks for a class action. Please stay in touch and if you have any addresses for him I would be grateful!
