Dropping all the Ozzy songs from the set when they reunited in the 2000s was the smartest thing they could've done.

They could have used it in the 2000s, Tony still owned the name and Ozzy didn't try to sue for it until after Dio had died. They changed the band name because they had just done six tours with the Ozzy lineup and didn't want fans to be confused.I saw them in 1982 when they were still able to use the Black Sabbath name and I thought RJD kicked ass on the Ozzy tunes . Gotcha , I thought that they couldn’t use the Sabbath name because when RJD came back for the third time Sharon and Ozzy were now owners of the Sabbath name. It was the right thing to do. Sabbath with Dio was a totally different band than with Ozzy, especially after Bill Ward quit during the Heaven and Hell tour. Dio Sabbath is as different from Ozzy Sabbath as solo Ozzy is from Sabbath.

Ozzy's argument was that Tony was reduced to playing in clubs until the reunion in 1997, which dramatically improved the status and value of the brand. So basically, despite Tony not being successful on his own, he received a disproportionate share of profit from the group's reunion, including things like merchandise featuring the band's likeness, licensing of the band's music, etc. which he had final say on. I wouldn't be surprised if an element of this did leak into Heaven & Hell. Perhaps changing the name was an attempt to prove the band could be successful without the name? If they had inklings of Ozzy's discontent with Tony being whole owner of the Sabbath name, maybe it would have aggravated things if they'd used the Sabbath name and possibly opened themselves up to being accused of piggy-backing on the Ozzy reunion. Notably, "The Devil You Know" was released just weeks before Ozzy's lawsuit was filed, and the album cover featured Sabbath's demon logo.
Either way, I would say that business aside, artistically Heaven & Hell is a much more fitting name for the band. Calling the group with Dio and Vinnie "Black Sabbath" makes as much sense as calling Audioslave "Rage Against the Machine," Velvet Revolver "Guns N' Roses," and Van Hagar "Van Halen" would.
