Some dude selling mp3 music collection on craigslist...

So why exactly is it his burden to proove he bought the mp3's?? Isn't it our burden to proove he didn't?? So I can buy cd's, rip them to digital and then sell them but no one has an issue, but if I buy digital and sell it everyone is up in arms. I don't see it I guess. I won't buy digital mainly because of this....I just feel the need to have a physical copy of anything I buy so I have proof of how I obtained it and if I want to loan it to someone I can. It's same with books now. I would LOVE to go grab a kindle but I share and borrow books all the time and sell a lot of them also but once you go digital it can no longer be shared, sold, nothing.

If the guy bought his mp3 collection I don see why he should expect to be able to sell it and the mentality that he should have to proove he didn't obtain it illegally goes against EVERYTHING this country is about. Not saying I approve o pirating music, just saying the industry should have not had the attitude they did 15 years ago when the digital age was coming about and they wouldn't be in the pickle they are in now. You realize that before cd I was completely legal for me to copy a cassette and give it to my buddies...that's why there were all the dual cassette decks out there. Or to copy an album to cassette and give it away. It was all fine as long as you didn't sell he copies.

Don't want to derail the thread so I will stop there. I don't see what the guy is doing as wrong and if they are illegally downloaded music it should be up to us to proove it not the other way around.

I thought that if you ripped a cd and then sold the disc, you are in no different position than downloading an mp3 without paying for it. Having the physical disc in your posession entitles you to use the media for your own personal benefit, whether on disc or mp3.

I believe it was still illegal back then as well, Hence the term "bootlegged" it just wasnt so exposed or easy as it is today. Just like it was illegal to copy VHS movies. Its all the same.

The fact that the seller in the above ad says he'll sell you his files is total bullshit because he is clearly offering it to multiple buyers.

I think if I remember correctly cassette was considered lower quality than Vinyl so it was never seriously pursued. Also it was considered OK to be able to make a copy for yourself as Vinyl was exactly sturdy. With digital you can make a perfect copy and as many you like in great number. Plus like the other poster mentioned, I'm sure he would be fine selling his collection as many times as he could.

The law recognizes that many uses of copyrighted works -- even without the permission of the copyright holder -- are not an infringement. While there is no "right" as such to make a fair use, the making of such a use is not an infringement.

Thus, if you make copies for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, it is not an infringement of the copyright, even if the copyright holder does not want you to do so.

Making copies of those old cassettes was legal as long as they are not for sale. the same still applies now to the newer media.

Am I wrong on this? I need an atty...
You can copy media all day long for your personal use but make a copy for sale/distribution and it's illegal! I mean, weve all been f'n theives at one time or another with this I'm sure, But if the company or more importantly IMO, the Artist, isnt turning coin on the sale, it's your ass, isnt it?!? is this even a debate?!?? not that most folks have time to personally sue a jagoff thats making bank on someone elses work... Just pisses me off that someone profits on the sweat of someone elses talent/work. Thats what record labels are for!!!

Oh, and Savage? You better believe you and your disk were/are worth all that $, AND a bag of Idahos' best for good measure, know what I mean?!??
