He's not wrong. The legal incidence of the tariff falls on the US importer. It's the US importer that is on the hook for paying the tariff to Treasury, filing returns, posting surety bonds, etc. If Treasury is going to issue refunds as a result of the court decision, it's the US importer that has recourse. Not the foreign seller nor the end consumer.
The economic incidence of the tax can land several places. The foreign seller could lower their prices to keep the sale. Walmart is notorious for pushing back price spikes on suppliers. But for most other US businesses that cannot leverage their supply chain through volume, and especially smaller businesses, they will either absorb the tariff out of their margins, pass the additional costs along to consumers, or a combo of both.

The law they used to rule on this basically is a law that gives the President a lot of power over tariffs in times of emergency/war. It's not a limit on them. They basically said, well, if we're not in a time of war, these tariffs are too extreme (they have no basis for determining how extreme they are, only on their 'muh feels') so the president and his advisors decisions aren't applicable. Completely retarded. They worked backwards to arrive at their conclusion. Roberts is a piece of shit neocon.
So now we have precedent where the supreme court can just decide to interfere with executive economic decisions they have absolutely no right to. Insane. I'm sure this will go well in the future.

They unanimously ruled against Biden and Obama using the same rationale of the majority opinion. 2 of the 3 appointees kept the same stance they had on prior rulings and 1 went against his own previous rulings.
