The loopholes are really what it's all about, because the intention of a trademark is to let you do one thing: Brand your business. So the rules are quite strict to keep it from being abused.

A bit off-topic, but coincidentally, a fellow guitarist of mine has had a Dean ML for a long time. Fantastic guitar, sounds good, easy to play... He really wanted at least one Gibson. So he bought an Explorer Tribute (I know, it's low-end, but still Gibson). He regrets it now, Dean is far better. He is most disgusted with the bad quality of the neck and the fretwork.
