It finally happened to me... they lost my package.

Monday I have a slip in my mailbox saying a parcel has been left in my apartment complex's office by the US Postal Service. The office is closed by the time I check my mail so I go on Tuesday to pick it up. They can't find it. I go in the room where they hold the packages and I can't find it either. Its just not there. The apartment complex employee looking with me says to come back tomorrow and that maybe the mail carrier forgot to drop it off and will have it tomorrow. Bullshit. I don't make it home in time before the office closes yesterday to see if it was there so I go back today. Still nothing. I call the post office for my address and they don't have it there. They told me to call the mall carrier in the morning to see what they say, which I fully intend on doing.

I'm ready to smash someone's face in. This is pure negligence. Who do YOU GUYS think is at fault? I'm leaning towards the apartment complex. Why would the mail person put the slip in my box and then not leave the package in the office? That doesn't make sense.
 
man that sounds pretty shitty. even if USPS dropped off the package, it sounds like some SERIOUS negligence on the office's part. :thumbsdown:

what was in the package, if you don't mind me prying? guitar stuff ;)

I can't tell who is at fault yet - we need the mail carrier's side of the story...

This is why I have EVERYTHING delivererd to me at work. 2x12 cab or picks. doesnt matter. it all goes there.
 
Sue for gross negligence, mental anguish, breach of fiduciary duty, and I'm sure if you look into it there is more that you can throw in there. I know that's pretty stiff for a $50 pedal but smack the shit out of them. :gethim:

EDIT-This is clearly the apartment complex that is at fault.
 
Just spoke with the mail carrier and received the delivery confirmation/tracking info from the shipper. They delivered it. And the mail carrier said the people in the apt. office asked them about my package then ADMITTED to having lost packages in the past. It's ON now!

My lesson has been learned. This is how I will roll from here on out.

UPDATE:

I spoke with the apartment complex manager this morning. She basically talked in circles and gave me the runaround. I said point blank "I need to get this item replaced." She said she would talk to the mail carrier today and call me after lunch. I said I already talked to the mail carrier, they said they delivered the package, the notebook in the package room said the package should be there, but it isn't. They are taking no responsibility for the package not being where it should be.

I don't know where to go from here. I don't exactly know my rights here. Can I take them to small claims court? Is it worth it for a $50 pedal?
 
I'm not an attorney but yes you can sue. As to whether it is worth it that is up to you. It is a $50 pedal but if you don't mind missing work you can sue for lost wages, all of the above and probably more. You may be able to get an ambulance chaser to work pro bono. You also have to consider that they are the office for your apartment complex. They may do some shit to you at the end of your lease like slap you with a $3k cleaning bill and yank your deposit if you have one.
