I just don't like this idea of being able to own a shape of something. Logo? Yes. But shape? That's sort of like saying I can copyright a mug for my tea. Most other musical instruments do not have this issue of being able to control a shape. The other argument though is that the Strat shape has been the most popular (aside from the LP). Still, maybe they should work out a legal requirement where Strat copies would send 1% of the profit for each guitar to Fender? I don't know. I'll still continue to buy Strat copies.
Right. There's so many shapes that had a first realization, with many following the formula. It'd be like saying whomever invented the guitar pick shape should have a copyright on that shape lol

Leo still created / invented these original designs. When he sold his Fender company, he sold the rights to his Fender creations and designs.

The difference an american made fender and a mexican is only which side of the fence the mexicans assembled it. Chill out. Ford should sue everyone with a car with 4 weels too eh?
You can buy fake rolexes and sheet all over, still people buy the real one priced to he startosphere, becasue they know they will get a quality product.
People buy boutique made fender like guitars, because they want a quality product without the fender custom shop price tag and 2 years of wait time.
American made standard fenders are meh at best, probably have 5% above mexican made, which means the mexico factory levelled up on QC.
Captilaism at it's best what america is, so they have outsourced everything to china, to increase profit amd share value.
Same the Spanish did when they have conquered the americas. Outsourced everything to the netherland and it bite them in the ass.
Now china owns the majority of the US's debt. Basically US is the dog of China, due they can ruin the US economy in 1 step. GG

You're right...
The thing is, what part did Leo sell that *still* holds legal value at this point?
Any patents have expired already, as they do after 20 years.

The headstock shape was trademarked, this TM still stands, so it can still be legally enforced.
That's why my '09 MIJ Charvel has a disclaimer sticker on the back of the headstock about this.
But since there was no -as far as we can tell now- established trademark or even trade dress regarding the body shape, this becomes a grey area at best. It seems Leo never put in that work.

Their current copyright claim to a cherry picked court is shoddy, tweaked with a purposeful twisting of historical facts, decades too late and currently not set up legally fully contested with actual merit yet.

Only a rrrroyal boob would think otherwise... 🤏

making changes to the original designs is a derivative which is still a form of cpying.
An innovative form though. But again, not required for copying to be valid.
The fact that Fender can't legally monetize or defend their original design does not change the fact that they created the original design

Your post doesn't seem to provide support for your claim that independent of the law copying is theft and morally wrong, which is the thread I'm pulling at.

Here is what I said:
Nothing was taken. The idea for the guitar was not plucked out of the creator's head, nor were they deprived of any of their property. They still have all the guitars they made, or the money they got in exchange for them.
Care to explain how copying is stealing when nothing is taken?
