It never should have been a crime. Inter racial relationships used to be a crime too. Those being considered criminal was a bunch of bullshit. Nobody has gotten worse for those actions to become legal. (Most) People just aren't as bigoted these days and know that those things are harmless unlike the axe murderer you mentioned earlier.

Plenty of things can be considered criminal even though there are no victims. Drinking and driving is (potentially) a victimless crime as long as the drunkard doesn't crash into some innocent bystander on the way home.
