I would just sit tight with them for now, and don't decide to do anything with them just yet. I believe Jake is right though.

Normally I would agree with this, but not in this case. As I said earlier, Microsuck is scandalous and I think it's ludicrous that they haven't just fixed the problem with the hardware yet. It's not stealing from 'someone', it's stealing from a dishonest multi-billion dollar company. I was thinking about calling them and asking if they have the shipping records for my order. Tell them I was sent "an extra.." and see what they say. If they say keep it, I've got 5 boxes. Any time you steal something it comes out of someones pocket. It does not matter if it is a company or individual. In this case it would seem no one here knows who's pocket that is.
As far as legal or not ..... who cares. I can think of lots of laws that are very wrong. That is hardly a good a way to judge if something is wrong or not.
I would give them back myself.
