Fender should own the legal rights to Telecaster, Stratocaster, offset and other original Fender body shapes and designs.

I was sitting in the home office earlier today and heard something strange. Apparently, it was Kid moving the goalposts so another one of his “projections” would beat the experts. What a dumbass 😀

All of a sudden a settlement was obvious....


But again I projected it ahead of the "experts" donkeys in the industry and as said its the most probable/likely outcome vs anything else anyone cares to mention or has brought up so far.

I disagree with this one, at that point Fender would be pushing it's luck.

They can and they could but it doesn't mean they should IMO in that case. The offset stuff would be easier to defend than the Strat too, the Tele not so much as it's older and it's pure utility.

All three of those body designs are Leo's original creations and designs...there are more original designs including the basses.

It's gone too far the other way for decades, against Fender (and Gibson) which is why it will be difficult to reverse; and why I said it's a longshot for Fender to win any legal rights to their own original designs.

As an example of a company that vigorously defended its designs in court, in the market and everywhere else since they were created: Rickenbacker.

Fender (and Gibson) failed to do this effectively.

This is true but law changes with the times and in these times the law is on Fenders side especially by way of settlement given how these European laws have opened the door for them to do so in Europe.

While I think Fender probably has a stronger case for its other designs to defend (not including the Tele) and even more of a case than the Strat IMO why push their luck and they already have more than they want with a likely and most probable settlement that would be in their favor at the end of the day :dunno:

Funny you mentioned disappearing 'cause the reality is that it's the only thread I've read since I commenced this unfortunate hiatus. I figured seeing as I posted the topic I had an obligation to at least monitor it.

I feel I've let the board down and feel terrible about that. I wish I could predict when I'll be "OK". Hope you're all well.

Anaheim sucks. And it sucked when I was there, long before you were born. Dumbass.
 
there is next to zero point in Thomann going for a settlement as the case is broader than just damages. Initially it’s a confirmation of intent and defining or redefining the ruling which was given as a default in the absence of the other party.

Beyond that, it’s about manufacturers big and small who could well go out of business as a result, traders who will lose a broader range suppliers and potentially many having unsalable stock.

Damages isn't going to resolve all of those concerns.

Whether one agrees with business behaviours isn’t up for grabs.
