Ebey has banned me for 30 days (update)

Yes I'm still suspended for 30 days and they told me not to relist this guitar or my account would be terminated. It sucks because EVH has had such a huge impact on me in playing the guitar, I cant be mad at him, he'll never even hear of this. I dont understand this whole thing but what the hell, I'm going to keep the guitar.

He's really uptight about people using his "intellectual property", and he probably knows about this in general (although probably not specifically about your auction). It doesn't matter to him if it's one person (even a big fan) who made himself the guitar and later decided to sell it, or someone making a batch to make money off them specifically. He doesn't want it happening, period.

I say go ahead and be angry at EVH over this. Or if you really respect him, try to see it from his point of view (even if it's really hard to do).

If you don't want it just throw it on Craigslist or have someone you know relist it on eBay for you. Just make sure you put some generic description or disclaimer on it or something?

I had the same thing happen to me selling a 5150 replica.
I was contacted by Ebay and EVH's company/lawyers/douchebags/whatever.
Their reasons were that EVH has a patent on the red/black/white and black and yellow design.
Unless it is officially licensed, you can not sell anything that even resembles those paint jobs.
Bullshit either way.
I wound up selling mine on craigslist

get yourself 2 more ebay handles too.

get some feedback on both. tie each to a paypal account, tied to a different bank account.

use your parents address, work address, girlfriends address, etc.

+1. I got flagged a couple of years ago tryng to sell a striped Kramer. Ended up selling it on the gear page...You guys are going to want to throw me off the board for what I'm about to say next ('cause I think the copywrite "striped" thing is ridiculous as well) but I am an opportunist.

I took my kid to McDonald's one afternoon this past summer and they were undergoing a minor cosmetic renovation. I look up and there hanging from the ceiling are 3 decorative pieces of glass with an EVH stripe job
So I went home and tracked down Matt Bruck thru EVH's accounting firm and tell him I have something he might be interested in seeing. My delusional hope was they would nail McDonald's to the wall and EVH would send me some free gear for my trouble. Matt actually followed back up with me. He said they investigated and found it to be an isolated incident...So much for my free wolfgang and 5150III You would think I could have at least got a free pair of those sneakers
