I don't like how everything has played out from fractal either, but the TM presale was just that...a TM presale. Fractal doesn't have anything to do with it, TM requested the deposit and is handling the presale for THEIR customers, not fractal. The problem here is this...WE don't know the agreement between fractal and TM. TM was EXPECTING so many units per month, and from the way things were talked about they were expecting a shipment in June and another in July...25 each month (ergo the 50 presale slots). Now, fractal says that TM's first shipment was EARLY, and it was shipped at the end of June...so, maybe there was a mis-communication and shipments weren't supposed to start until July...either way, TM still hasn't received it's expected first allotment, and it's now August. There have also been many emails where TM has relayed expected ship dates from fractal and each time they keep getting pushed further back...unless TM is just making up dates (which I dont believe) then they have to be getting info from fractal.

The only issue here is whether or not TM is getting their monthly allotment of units from fractal as promised.....which DOES NOT seem to be the case...they surely haven't been getting 25 a month which, from my understanding (which could be wrong), is what they are supposed to be getting.

From what I have read, the deposit for the unit goes to Fractal, which is why if you request off the list you can;t right away as the deposits have been sent to Fractal. So at this point Fractal has the deposits and had for some time.

If that is true I think it would be incorrect to say that Fractal doesn't have anything to do with.

If this is true it is truly TRULY a complete and utter disgrace... Seriously.

I would think it would be a lot more reasonable for Tone Merchants to still hold on to the money. I would find it odd if that wasn't the case. However, if that's true and Fractal has the money then it is outrageous.

I'm going to speak for myself as an example but it stands for anyone on the Tone Merchants list. If Fractal has had my full payment for the AxeFX II for the last 2 months then they have a lot of explaining to do as to why they sold units to others that paid after I did and why I'm still waiting for mine. That would be inexcusable and imperative that they rectify that situation immediately.

Brad, Rob ? Does Fractal has the deposits money or are you guys holding on to it and pay Fractal as the units are shipped?

As Ventura said, it would be a total utter disgrace.

*Edit*
For this outrage, Fractal should provide all of us with a free MFC-101!!!! Or a T-Shirt ?

Hmm, not sure where the idea came from that Fractal has the deposit money...that doesn't make any sense to me...I don't think that's the case. If so, then I'd be upset as well, but I really don't think that's the case...

Some of you guys really need to get out and meet women or something, last time I saw this shit happening was when IBM released the PCII and nerds were jumping out of windows due to backlog..............................

Nail on head.

I don't know what is more entertaining, AXF2 or anything having to do with with Cameron. Glad I am not interested in either!

It's not yet confirmed and it is highly speculative at this point. I don't believe this is the case either. If it was the case however, that would be a good enough reason to be upset.

My previous posts reflect my doubt on this matter and my reaction to if this is true.

I run a small business myself, and if I take a deposit on something I sure don't send that to the manufacturer while I'm waiting for them to send me my merchandise. They get paid when they ship it. That seems most logical to me...

You're right, the top three has to be EVH's early rig, Cameron's shady deals and everything Axe II so far.

I just wish someone smart and opportunistic would get their hands on one, and completely reinvent it for the better, and blow FAS out of the water with professional competition :D

Eat that.

So it goes, monopolies and the like. Power corrupts, absolute power corrupts absolutely. Was no dis to TM, albeit I distinctly remember FAS stating NO pre-order lists. TM came along and offered their wares for 50% down, and for the most part, they've got 35 cats' 50% down in holding right now - which I am sure puts them, and several of those who paid out, in a somewhat 'awkward' and uncomfortable position.

Ain't nuthin' to do with TM. Started out as a good idea, and my guess is there was some serious alliance to the straight up business model and style of TM, and people, 50 people to be exact, gravitated towards it, and Cliff got pissed at this and is now f*ckin' with the TM program.

No surprise.

Second that!

Cliff his ulcer has taken over his brain function. It looks like he kicked Tom King his products out. So Tom King is propably pissed. G66 and TM are pissed. Customers are pissed. And personally I got kicked out for life and mine IP is blocked huuuuraaayyyyyy

Way to go Cliff!

It is sad to see how he wreckes is own business with his untrustworthy and unreliable behavior towards all those that make or kill his business.

So NO more new FAS products for me and I intent to keep mine Ultra and MFC until this stupid monopoly is broken. And it will be broken within the next year. Oher parties are not sleeping and see the market need. So digitech, line 6 or other companies there is a very nice market for you guys here or just buy this chocolate factory.

What's this about Tom King?? I've not stepped foot over to that site in ages... It's always a source of frustration for me, so I don't go. But I'm interested in figuring out what happened with Tom - he's a solid guy, I spoke with him on the phone not that long ago and seemed like a straight up, nice guy.

This will be my first and last FAS product, That's IF I ever get it
They, Fractal have left a really bad taste in my mouth and I just dont continue to deal with company's like that.

My speculation is based on this official statement on the FAS website:

To better serve our respective customers, Fractal Audio Systems and Atomic Amps will no longer share a website. You are now visiting our new, streamlined site. Please visit the web site of Atomic Amps for information on their products.

But I doubt this is the real story.

Why can't we get our deposits back? Unlike custom ordering an amp where parts must be ordered, FAS and TM incurred no expense to park our money in one of their bank accounts (in fact they should have earned a couple of months interest at the very least), and with three waiting lists, they certainly would just move everyone up one and reduce the future order by one, again not losing anything.

Not to mention that Fractal has a 15 day return policy, so technically we can return the item for a full refund and we are certainly well within the 15 days.

Unfortunately, this probably screws us on purchasing the product and being able to return it in the future.

^^^ screwed how???

We haven't purchased anything yet...the 15 day period as well as the warranty still applies...

If you order a car from the factory and it takes 6 months to build it an get to you, your warranty starts when you get it, not when you order it. Same applies here.

And I never saw anything about not being able to get your money back from the deposit...where did you see that? It wasn't mentioned anywhere in the presale ordering post that I've ever seen...???

I personally don't want my money back...I just want me Axe 2!!!

I said screws you from being able to purchase the product in the future (maybe I should have said again) and having the option to return it, as cancelling your order would probably count as a return..

From FAS's 15 day return policy: "If you purchase a product and return it you are not eligible for the guarantee on any future purchases of the same product."

As far as not being able to get your deposit back (I was talking in general, not to anyone in particular), several posters on this thread have indicated that they would like to get their money back. For example, look up four posts to mindseye (and he isn't the only one).

Then of course while I was posting, mindseye has edited his post and removed the line about wanting his money back.

^^^ Ah, I see what you were saying...

But I don't think canceling a presale would count...? I mean, you've never had the product so how could you use up your 15 day return...there's nothing to return! The only difference with us (from the fractal or g66 list) is that we made a deposit as requested by TM. But it's just a deposit, not a sale...at least not until your unit ships to you.

I really don't see why people couldn't get their money back if they request it...nothing has been delivered to them...they should be entitled to it if they so choose...no???
