Maybe, maybe not, the deposit is a contract to purchase. It all depends on how they look at it. As far as getting your money back, try sending TM an inquiry about getting your money back and let us now what the response is (I don't know what their response would be, I asked twice if this was an option via email last week - no reply).

My understanding is if you can find someone else to take your spot on the list who isn't already on the waiting list then they will issue you a refund once the replacement deposit is received.

also Fractal doesn't have anything to do with the deposit or TM's waiting list.

I never signed anything stating it was a contract to purchase...even if you did, there would have had to be a timeframe stipulated, othwise they would never be obligated to deliver!

I don't want my money back! Just saying that it should legally be an option for those who do! I've had nothing but a good experience so far with TM, it isn't their fault that Fractal hasn't sent them more yet...

Yea I did edit my post after I thought about what I said I thought it sounded a little harsh.
I am just starting to get a little fed up with this since Fractal has had them in stock in their store every time that I looked over the last few weeks but none have been sent to TM.........even if they sent 2 a week or something they would be knocking the list down.

About a month ago I was told that Fractal would be sending the next batch in two weeks and well here we are 4 weeks later and no dice. This is not TM's fault either as far as im concerned!!!
Id be willing to bet TM is prolly just as tired of waiting as we are just to get us buyers off their back..lol
 
Do you guys think that it's beyond the realm of possibilities, that Fractal may have taken offense to the deposits scenario and the"we'll get the units the same time Fractal corporate gets them". May be they want to catch TM's wiener in their zipper. I don't know how vindictive Cliff is. :dunno:

and possibly gets off on all these guppies begging for his unit. Maybe in the act of "getting back at these fucks" (and by "fucks" I mean, if someone is so well disciplined in this behavior it wasn't drummed up overnight, TM is just the tip of the iceberg. The iceberg being years of hostility bottled up by being unappreciated) someone could conceivably develop an ulcer. "Chillax" -may be a scam, a front. Just guessing :dunno:
 
The issue with the vindictive part is that so far, since everyone keeps blaming Fractal instead of Tone Merchants for the situation, Cliff's inaction with the TM situation is just f*cking with the customers and on a business standpoint... you NEVER want to do that. If he wanted to screw with Tone Merchants he would probably threaten to sever their business partnership like he did in the past.

I see no reason for him to hold off shipments. I doubt Cliff would do something like that. He may have a temper but I can't imagine for him to get so personal with business issues.

Of course this is all still speculative at this point.

We can only physically process so many orders a day. If we were to dump 100 units in the store they would undoubtedly sell out that same day. There is no way we could ship 100 units the next day. So then people would be bitching and moaning that their unit hasn't shipped yet.

So we put a certain number of units into the store each day that we know we can fulfill the following day.

Today those units sold out in 90 seconds which I found humorous but those with impaired funny bones took as an affront.

Tomorrow more units will be placed in the store. The next day we will again place units in the store and so on.

This is the way it works. If you don't like it or feel insulted by it or by what I have written then don't buy it.

A lot of you need to check your attitudes at the door. The amount of self-entitlement being displayed is absolutely revolting

The only thing with all this is that, Cliff was sort of right. The message was just badly delivered. None had a reason to complain. They were just a bunch of impatience kids that cried like they were victims of an injustice. Fractal owed these people nothing. Now, all they have to do is wait for their coupon or forget about it. They still have no reason to complain. Those who had genuine complaints and concerns got banned and censored like Ventura, DADA and those where the Axe II was announced right after their 15 days return period was over for their Ultra when they were told no new products were on the way.

When money is involved, things have to move. If TM were getting their units as they should, there would be nothing to complain about. That's all there is to it. Tone Merchants said "25 units per month from the moment they are released" and this hasn't been respected. It doesn't matter who is to blame or why. Things should be happening. Given that, Fractal is 38 units behind on their delivery schedule. The only valid reason to wait was for the units to come out the production line and they have long since been shipping. No other reason is relevant.

The situation is exactly the same right now as going somewhere and having to pay to wait in Line 1 and then eventually after 3 hours of waiting, another line opens up where not only people don't have to pay to line up but they are being served right away, with no reason or explanation why they should be served first. Also, those on the first line can't leave or get their money back while those in the line 2 can just leave at any time and go to Line6. And then there's line 3 where if you pay more, you get the VIP treatment and don't have to wait. Would you be pissed if you were in Line 1?

I don't want my money back. I'm in Line 1 and given the situation, everyone in Line 1 should be getting theirs before or at the very least at same flow as those Line 2. Any other way around is unacceptable. That's what I called getting screwed.

I wouldn't expect those who aren't in the TM waiting list to understand. It all seems to be more of the same AxeFX II Drama since the first day it was released. I wouldn't waste my time posting if there wasn't a genuine reason for it.

I agree. The only issue here for me is the fact that TM was promised 25 units a month and have only seen 12-15 and the Axe has been shipping for 2 months now, and they are selling stock every day. This is my only issue with everything...Fractal can sell them for more so they stop delivering as promised to their dealers??? Seriously??? I don't even know what to say about that...

Axe-FX II - nice but gone like the wind

I've been gigging with an Ultra for over 3 years now so I was pretty stoked to get the II. I paid the jump the line price. It came. It sounded very good but it didn't smoke the Ultra. Not by a long shot. The interface is a little nicer and the defaults are more sensible in most cases. The biggest improvement for me in terms of getting good tones quickly was the addition of a lot more cab IRs preloaded that I liked. I spent a fair amount of time dialing in tones and playing a variety of stuff. The sonic improvements are there but they weren't the kinds of things that are going stand out in a mix or make me "connect" with it any better. As we've seen already, future firmware can improve things substantially over time so the prospects are good. In the end, I just didn't have a compelling reason to switch to the II at this time so it's gone.

In the end, it's still a modeler (for better or for worse). It's still just *almost* as good as the real thing. I hadn't played a gig with a traditional tube rig in several years until this past Saturday. It was awesome. So much so that I think the Ultra is going to get sidelined for a while.

I have to disagree. That 10 day count down to an indefinite waiting period and horribly flawed roll-out leaves potential customers with much to complain about.

EDIT: I think I may pick up an Ultra once the price is right to use a sole FX rack unit too. All things considered, it was an AWESOME all-in-one effects piece, so I'm just waiting to see the prices go rockbottom and may end up getting one as a beater.
