Sent Paypal FF $1,500 on October 6th. Donald claimed he would send tracking # next day. No tracking #, so on October 9th he sends PayPal refund. PayPal refund is taking awhile then shows cancelled. On his social media post on Oct. 9 he claims he has the right to refund me and Not send guitar. I am not on that social media but have friends that are. Which is fine but then he eventually cancels the refund.

My bank could send Paypal a report but since it is FF it would be meaningless as Paypal washed their hands of the transactions.

LE can charge Donald with "Obtaining property by false pretenses". I would have to fly across the country for that to happen.

Can you get your friends to take a screenshot of said social media?

Its not a reason to cancel a refund. Its a negotiating tactic :gethim:
 
Based on your story, it seems like he may have found a buyer locally after you had already paid. Then in the midst of refunding you, he decided to say fuck it and kept the money instead.

Or he said fuck it, and just decided to keep the guitar AND your money.

Either way Clint you are quickly running out of time to make this right.

In a last case scenario, you could probably file a small claims suit for conversion, fraud, etc. Get a default judgment because he won’t respond. THEN go with the sheriff/LE to his door to recoup your money (including court and travel fees).

Or you could hire a private investigator to go knock on his door and demand your money.

There are options here and you don’t have to take it up the pooper.

"Obtaining property by false pretenses" in this case is a felony according to the Officer I just talked to. I might not have to fly out there until the court date...

If it was your bank you can still claw back the funds. If PP went through your bank account. I did that 12 years ago when I sold a Jubilee combo to someone...he sent it back for a refund....but he sent a DIFFERENT Jubilee combo back to me. One that was beat to shit, and a different serial # to boot. I opened up a case with eBay and went right to my bank, and got my money back.

This is what I expect people to do when you don’t know them. One of the reasons I don’t sell shit.
