That's an example of 1. And it's a high profile example at that. I personally know 3 different people who got charged with murder, convicted and did less than 10 years. The thugs that robbed and murdered my best friend in 2003 did less than 10 years. Life in prison is on average a 12 year sentence.

That's a great question and one you could also ask yourself since most of latin america has much tougher gun laws than the USA i.e they aren't working. Since all guns are mostly illegal or very tightly controlled there, they are something mostly in the realm of criminals from the outset vs the USA where most people who own guns are more or less law abiding.
