Yeah, but I don't believe this guy will live up to paying all of it. At least that way, he could flip the guitar...

the small claims court thing is worth pursuing, he can be made to come to your State. but the positive thing about is that if he misses some court dates, then an arrest warant can be issued. also, not sure, but may have to find somebody to serve him the court papers?

It actually works the other way around. If you bring something to small claims on somebody in a different state, you have to appear in their state.

i've been through this, my State would force them to appear according to my local court.

+1
He will have to come to you. Serving him will be a problem though

hey japetus, i get your point. sell the guitar for cash and make money off of it.

if anything though thats not will's problem. that guy should pawn that PRS and then get a loan to pay Will back off, and not take this shit way out with payment plans.

that is way off the track from the intended reason of purchasing a SLO.

you cant mail him the served court papers can you? i dont know much about that legal stuff.. im guessing they have to be handed to him personally by an officer or lawyer?

Good news is I got the $1000 back from the credit card. $1450 to go.. I am too busy to deal with this shit, it's almost 2am and I'm still at work right now

I could not deal with $200 a week. This is ridiculous. Guy cant come up with $1600. Smells like BS all over the place.

so has this gay fucktard been keeping up with the payments? regardless he should pay you back one lump sum?

It's funny...we were just studying this in my law class...it all depends on where you file. If Will files in his home state the dude will have to come to him.

If its sold I would think he would have sent you the money the guitar sold for!

Cyndicate, sorry to hear this man...situations like this really suck  Seems like the guy needed a loan so he got one from you and wants to pay you back at his leisure.
If he is telling the truth though, (which I very much doubt,) he should do WHATEVER he can to get that money now and make it right!
We could all call him 5 times a day and hound him for the money. :D

His phone # is in herehttp://www.rig-talk.com/forum/viewtopic.php?t=12289

I skimmed the thread... my thoughts:

1) if the amp was stolen and he SOLD it to you, there is no way in hell he would not file a police report. What a piece of shit.

2) If he sold that PRS after his amp was stolen, he owes you THAT money.

This is insane and you're being way too nice a guy.

Pete
